Terms of Service

These terms govern your use of Niu People, the workforce and attendance service available through this website and its attendance kiosk app. By creating a workspace, signing in, or pairing a kiosk device, you agree to them.

Who "you" means. Most of these terms are addressed to the employer — the business that opens a workspace and enters its staff. If you are an employee clocking in on a kiosk, your employer holds the account and these terms bind them, not you personally.

The service

Niu People lets an employer record attendance, manage schedules and leave, run payroll calculations, and produce end-of-service settlements. Attendance can be captured on a shared kiosk device, optionally with face verification. We may add, change or withdraw features over time; where a change materially reduces what the service does, we will give reasonable notice.

Accounts and access

  • You are responsible for everything done under your workspace's accounts, including by your managers and HR users.
  • Keep credentials confidential, give each person their own login, and remove access promptly when someone leaves.
  • Kiosk pairing codes and device tokens are credentials too — treat them as such, and unpair devices you no longer control.
  • Tell us without delay if you believe an account or device has been compromised.

Your responsibility for employee data

You decide what personal data about your staff you put into Niu People and why; we process it on your behalf. That means you are responsible for:

  • having a lawful basis to collect and process it, including face images where you enable face verification;
  • telling your employees what is collected and how it is used, and handling their questions and objections;
  • the accuracy of what you enter, and of the payroll, leave and end-of-service figures you approve and act on.

Calculations are a tool, not legal advice

Leave accrual, indemnity and end-of-service figures follow Kuwait labour law as we understand it, using the settings and data in your workspace — including your chosen daily-wage basis. They are a working aid. You remain responsible for what you actually pay. Review every settlement before signing it off, and take professional advice where a case is unusual or disputed. We are not liable for a payment made on the strength of a figure you did not check.

Acceptable use

You must not:

  • use the service to break the law, or to process data you have no right to process;
  • use face verification to track or identify anyone outside attendance at your own workplace;
  • attempt to access another workspace's data, probe or disrupt the service, or bypass its limits;
  • resell or white-label the service without a written agreement with us;
  • upload malware, or content that is unlawful or infringes someone else's rights.

We may suspend a workspace that is causing harm to the service or to other customers, and will tell you why.

Plans and payment

  • Paid plans are billed in advance for the period shown at checkout. Staff counted toward your plan are those not blocked or archived.
  • Payments are taken through our payment provider; we do not store your card details.
  • If a subscription expires, paid features and limits revert after a short grace period. Your data is not deleted for non-payment.
  • Fees already paid are non-refundable except where the law requires otherwise. We will give notice before a price change takes effect.

Availability

We work to keep the service running and to take regular backups, but we do not promise uninterrupted availability. Maintenance, third-party outages (including our hosting and face-comparison providers) and network problems can all interrupt it. Kiosks need an internet connection to record a punch.

Your data, and getting it out

The data in your workspace is yours. We claim no ownership of it, and we do not sell it. While your account is active you can export your records from the dashboard, and you can ask us for an export at any time. We keep the intellectual property in the software itself.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, business or data, and our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.

Ending it

You can stop using Niu People at any time and ask us to close your workspace — see Data & Account Deletion for what happens to the records. We may end or suspend access for a serious or repeated breach of these terms, or if we stop offering the service, giving reasonable notice and an opportunity to export your data where we can.

Changes to these terms

We may update these terms. The "last updated" date above changes when we do, and we will give notice of anything significant. Continuing to use the service after a change means you accept it.

Governing law

These terms are governed by the laws of the State of Kuwait, and the courts of Kuwait have exclusive jurisdiction over any dispute arising from them.
